Terms of Use

Last Updated: October 15, 2026

These Terms of Use (“Terms”) govern your use of the Psycho Bunny website at www.psychobunny.com and any other Psycho Bunny website that links to these Terms (together, the “Website”). “Psycho Bunny,” “we,” “us,” and “our” mean Psycho Bunny and its affiliates and related entities. “You” means anyone who uses the Website.

By using the Website, you agree to these Terms, except that the Arbitration Agreement below binds you only if you accept it as that Section describes. If you do not agree, please do not use the Website. You must be at least 13 years old to use the Website or create an account. To make a purchase, you must be old enough to form a binding contract where you live, and you confirm that you are using the Website on your own behalf.

IMPORTANT: THESE TERMS CONTAIN AN ARBITRATION AGREEMENT, A CLASS ACTION WAIVER, AND A JURY TRIAL WAIVER IN THE SECTION TITLED “ARBITRATION AGREEMENT; CLASS ACTION WAIVER; WAIVER OF JURY TRIAL.” THAT SECTION APPLIES TO YOU ONLY IF YOU ACCEPT IT BY CHECKING THE BOX AT CHECKOUT OR WHEN YOU CREATE OR LOG IN TO AN ACCOUNT. YOU MAY OPT OUT WITHIN 30 DAYS.

ARBITRATION AGREEMENT; CLASS ACTION WAIVER; WAIVER OF JURY TRIAL

A.1 Who Is Bound, and How You Accept This Agreement

This Arbitration Agreement (“Agreement”) is between you and Psycho Bunny. You accept this Agreement by (a) checking the box at checkout stating that you agree to these Terms of Use, including this binding arbitration provision and class action waiver, and then placing an order, or (b) checking a similar box when you create an account or log in to an existing account. Visiting or browsing the Website does not mean you accepted this Agreement. You may read this Agreement, and consult an attorney of your choice, before you accept it, and we will include a link to these Terms of Use in your order confirmation email.

This Agreement applies to you only if you live in the United States. It binds both you and Psycho Bunny. Our mutual promises to arbitrate are the consideration for this Agreement. Psycho Bunny’s affiliates, employees, officers, directors, and agents may enforce this Agreement to the extent the law allows, and may be required to arbitrate claims you bring against them to the same extent you would be required to arbitrate claims against Psycho Bunny. This Agreement does not expand any party’s right to compel arbitration beyond what California and federal law permit.

A.2 What Disputes Are Covered

A “Dispute” is any claim or disagreement between you and Psycho Bunny that arises out of or relates to your purchases, the Website, our advertising or pricing, or our Terms of Use, whether it is based on contract, statute, or any other law. This includes claims under consumer protection, advertising, and pricing laws. This Agreement applies to Disputes that arise after you accept it. It does not apply to any claim that cannot be arbitrated as a matter of law.

A.3 Try to Resolve It Informally First

Before starting an arbitration, you and Psycho Bunny agree to try to resolve the Dispute informally. The party raising the Dispute must send the other a written notice that describes the Dispute and the relief sought. You may send your notice to [email protected] or 5001 rue Levy, Montreal, Quebec, H4R 2N9. We will send our notice to the email address associated with your account or order. If the Dispute is not resolved within 30 days after the notice is received, either of us may start arbitration. Any statute of limitations that applies to the Dispute is paused while this informal process is pending. This step does not apply to small claims court or to a request for provisional relief described in the next section.

A.4 Small Claims Court and Provisional Relief

Either of us may bring an individual claim in small claims court, if it qualifies. Either of us may also ask a court for provisional remedies in aid of arbitration, such as a temporary restraining order, to the extent the law allows. Asking a court for provisional relief does not waive the right to arbitrate. Public injunctive relief is addressed in Section A.10.

A.5 Who Decides What

A court, and not the arbitrator, decides any Dispute about the formation, validity, enforceability, revocability, unconscionability, or scope of this Agreement. This includes whether the Federal Arbitration Act applies, whether this Agreement requires individual arbitration of all claims, and whether it allows class or representative arbitration. This is true even if the rules of the arbitration provider say otherwise. The arbitrator has no authority over these issues.

Once a court decides that a claim is subject to arbitration, the arbitrator decides all remaining disputes about that claim, including the merits and any procedural questions that arise during the arbitration.

A.6 The Arbitrator and the Rules

The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules in effect when the arbitration is started, which are available at www.adr.org. If the AAA is unable or unwilling to administer the arbitration, we will agree on another provider or, if we cannot agree, a court will appoint an arbitrator. The arbitrator will be a retired judge or another qualified neutral, subject to disqualification on the same grounds as a judge. If this Agreement conflicts with the AAA’s rules, this Agreement controls.

The arbitrator must decide each Dispute based on the law that governs the claims and defenses, and may not use any other basis. The arbitrator may award any individual relief that a court could award on the claims, including statutory damages, restitution, and attorneys’ fees and costs as the law provides. The arbitrator may permit dispositive motions, may issue subpoenas for documents and witnesses, and will conduct the arbitration efficiently and accessibly. Each side is entitled to discovery sufficient to arbitrate its claims and defenses, including access to essential documents and witnesses. No procedural rule may deprive either of us of a fair opportunity to present claims or defenses, or limit any remedy available under the governing law. The arbitrator will issue a written, reasoned decision. The decision is final and binding, subject to review as the law allows, and has no precedential effect. A court with jurisdiction may enter judgment on the award.

A.7 Where and How the Arbitration Happens

You choose whether the arbitration is conducted in person, by video or telephone, or by submission of documents. If you choose an in-person hearing, it will take place in the county where you live, unless you and Psycho Bunny agree to another location.

A.8 Costs and Fees

You pay a filing fee to start an arbitration that is no higher than the fee you would pay to file a similar case in a court of competent jurisdiction in your state. Psycho Bunny pays all other AAA filing, administrative, and case-management fees, and all arbitrator fees and expenses. If you cannot afford the filing fee, you may ask for a waiver or deferral to the extent the law or the AAA’s rules allow. You will not be required to pay any fee or cost beyond what you would pay if you filed your claims in court.

Each of us pays our own attorneys’ fees and costs, unless the law or the AAA’s rules allow a party to recover them. The arbitrator may award attorneys’ fees and costs to you on the same basis a court could. The arbitrator may award attorneys’ fees and costs to Psycho Bunny only if the arbitrator finds that your claim was frivolous or brought in bad faith, and only to the extent the law allows.

A.9 Individual Arbitration; No Class Actions

To the fullest extent the law allows, you and Psycho Bunny may bring Disputes against each other only on an individual basis, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not combine the claims of more than one person and may not award relief to anyone other than the individual party to the arbitration, except as Section A.10 describes.

If a court finds this Section unenforceable as to any claim, that claim will proceed in court, stayed until arbitration of all other claims is complete. If a court enforces this Section, it should dismiss any class claims without prejudice to the extent the law allows. Claims not subject to this Agreement will be severed and stayed pending arbitration of the claims that are.

A.10 Public Injunctive Relief

Nothing in this Agreement waives your right to seek public injunctive relief, meaning injunctive relief whose primary purpose and effect is to protect the general public from future deceptive practices. You may pursue a claim for public injunctive relief in a court of competent jurisdiction. To the extent the law allows, the court will stay that claim until the arbitration of all other claims between you and Psycho Bunny is complete. The arbitrator has no authority to award public injunctive relief.

A.11 Time Limits, Remedies, and Confidentiality

This Agreement does not shorten any statute of limitations that applies to your claims. It does not limit any remedy that the law gives you on an individual claim. Neither of us is required to keep an arbitration, its existence, or its outcome confidential, although the arbitrator may issue orders to protect trade secrets, confidential business information, and personal information.

A.12 Governing Law

The Federal Arbitration Act, 9 U.S.C. sections 1 through 16, governs this Agreement and any arbitration under it. To the extent the Federal Arbitration Act does not apply, the arbitration law of the state where you live governs, which for California residents is the California Arbitration Act (Code of Civil Procedure section 1280 and following). The substantive law that applies to your claims is applicable federal law and the law of the state where you live.

A.13 Appeals and Stays

If a party appeals a court ruling on a motion or petition to compel arbitration under this Agreement, any stay of the underlying case will be decided under the Federal Arbitration Act. If the Federal Arbitration Act does not apply for any reason, you and Psycho Bunny agree that a stay of the court proceedings during the appeal serves the purposes of this Agreement, and we will ask the court to grant a stay under California Code of Civil Procedure section 1294(a).

A.14 Your Right to Opt Out

You may opt out of this Agreement by sending written notice to [email protected] or 5001 rue Levy, Montreal, Quebec, H4R 2N9 within 30 days after you first accept it. Your notice must include your name, the email address associated with your account or order, and a statement that you opt out of arbitration. If you opt out, this Agreement will not apply to you, and the rest of our Terms of Use will still apply. Opting out will not affect your ability to buy from us or to use the Website. We will confirm your opt-out in writing.

A.15 Updated Versions of This Agreement

We may post updated versions of this Agreement. An updated version binds you only if you accept it in a way described in Section A.1, such as by checking the box at a later checkout. Posting an updated version, or your continued use of the Website, does not change the version you accepted. An updated version you accept applies only to Disputes that arise after you accept it. It does not apply to any Dispute for which notice has been given under Section A.3, or to any proceeding already pending. Except as this Section states, this Agreement can be changed only by a signed written agreement.

A.16 Relationship to the Rest of the Terms; Severability; Survival

This Arbitration Agreement is part of the Terms of Use but operates independently of the rest of them. If a court finds any other part of the Terms of Use unenforceable, that finding does not affect this Arbitration Agreement. If this Arbitration Agreement conflicts with another part of the Terms of Use, this Arbitration Agreement controls on the subject of arbitration. Any prior agreement between you and Psycho Bunny continues to govern Disputes that arose before you accepted this Arbitration Agreement. If this Arbitration Agreement conflicts with a prior agreement as to Disputes that arise after you accept it, the lawful terms of this Arbitration Agreement control.

If a court finds any word, term, phrase, sentence, or provision of this Agreement void or unenforceable, you and Psycho Bunny agree that the court should sever it and enforce the rest, to the fullest extent needed to allow individual arbitration, except as Section A.9 provides. This Agreement survives the closing of your account, the end of your relationship with Psycho Bunny, and any change to the rest of our Terms of Use.

Changes to These Terms

We may update these Terms from time to time. When we do, we will post the new Terms on the Website and change the “Last Updated” date. If the changes are material and we have your email address, we will try to email you. Changes apply from the date we post them and do not apply to orders you have already placed. We may ask you to accept updated Terms before you keep using the Website or make a purchase. If you do not agree with a change, please stop using the Website. If you keep using it after we post a change, you accept the change. Changes to the Arbitration Agreement follow the rules in Section A.15 and not this paragraph.

Notices and Messages

We may contact you by postal mail, email, text message, and notices on the Website, using the contact information you give us. Our Privacy Policy, at https://www.psychobunny.com/pages/privacy-policy, explains how we handle your information and how notices work. It is part of these Terms. If you place an order, you will receive email or text alerts about it, as you select. We may also email you to ask for feedback about an order or to suggest products based on your past orders and interactions with us. You can opt out of marketing messages using the instructions in the message or in our Privacy Policy.

Our Intellectual Property and Your License

The Website and everything on it, including text, images, designs, logos, and trademarks (together, “IP Properties”), belong to Psycho Bunny or our licensors and are protected by copyright, trademark, and other laws. We give you a limited, non-exclusive, revocable license to view and use the Website for your personal, noncommercial purposes. That includes sharing our IP Properties on a noncommercial basis. We keep all rights we do not expressly give you.

When you use the Website, you agree not to: (a) license, sell, rent, lease, transfer, assign, commercially reproduce, distribute, host or otherwise commercially exploit the IP Properties; (b) use hidden text or metatags that include Psycho Bunny’s name, trademarks, or other intellectual property; (c) modify, translate, adapt, merge, make derivative works of, disassemble, decompile, or reverse engineer any part of the IP Properties, except where the law does not allow us to prohibit it; (d) use any automated tool, such as a spider, robot, scraper, crawler, or data mining tool, to scrape or download data from the Website (public search engines may copy Website materials, on a revocable basis, only to the extent needed to build publicly available search indices); (e) use the IP Properties to build a similar or competing website, application, or service; or (f) copy, reproduce, distribute, republish, download, display, post, or transmit any part of the IP Properties, except as these Terms allow. If you use the IP Properties in an unauthorized way, your license ends automatically.

Your Account

Some features of the Website require an account. You can register directly with us or log in with a social networking account (a “Third-Party Account”). When you log in with a Third-Party Account, you confirm that you are allowed to share your login information with us and to give us access to that account, and that doing so does not break any terms that apply to it. You also understand that we may access and store content, information, and photographs from your Third-Party Account (“Third-Party Account Content”) so that it is available through your Psycho Bunny account. Information you post to your Third-Party Account may appear through your Psycho Bunny account, subject to your privacy settings there. If the Third-Party Account becomes unavailable or the provider ends our access, your Third-Party Account Content may no longer be available through your Psycho Bunny account. Your relationship with the provider of your Third-Party Account is governed by your agreement with that provider, and we are not responsible for personal information that provider shares with us in violation of your privacy settings. We do not review or vouch for Third-Party Account Content.

When you register, you agree to give us accurate, current, and complete information and to keep it up to date. You must be at least 13 years old, or older if your place of residence requires it, and you may not be someone who is barred from using the Website under the laws of the United States, Canada, or your place of residence. You may not create an account using someone else’s identity without their permission, give false age or payment information, or keep more than one account at a time. You are responsible for activity under your account. Do not share your password, sign out at the end of each session, and tell us right away if you think someone has used your account without permission.

You may close your account at any time. We may suspend or end your account if you give us false information, break these Terms, or if we have reasonable grounds to suspect either. If we end your account, we may keep enough information to prevent you from re-registering, to the extent the law allows. Closing or ending an account does not cancel orders you have already placed or affect rights that already accrued.

If you are protected by the European Union’s General Data Protection Regulation and ask us to delete your account, we will remove your personal information as the law requires. We may keep information we need to comply with legal obligations, resolve disputes, or honor your request not to be contacted again.

Your Submissions

“Submissions” means comments, reviews, feedback, suggestions, ideas, photographs, videos, and other material you send to us through the Website, by email or text, or on social media, including by tagging Psycho Bunny. You keep ownership of your Submissions. By sending a Submission, you give Psycho Bunny a non-exclusive, worldwide, royalty-free, perpetual, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display it in any media, now known or later developed, in connection with operating, promoting, and improving our business. If you give us a user name with your Submission, we may display it with the Submission. We do not owe you payment for a Submission, and we are not required to keep a Submission confidential or respond to it, unless we agree otherwise in writing. Please do not send us confidential information.

You confirm that you have the right to send each Submission and that it does not violate anyone else’s rights or any law. Please do not submit material that is unlawful, defamatory, obscene, harassing, or that infringes someone’s privacy or intellectual property rights, or that is spam or advertising. We do not pre-screen Submissions, but we may remove or block Submissions that we reasonably believe violate these Terms or the law. If you see a Submission that breaks these Terms, please contact us rather than responding publicly.

Content that other users post reflects their own opinions. We do not endorse it and do not guarantee that it is accurate or reliable, so please verify anything you rely on. You may see material on the Website or our social media pages that you find offensive, and we are not responsible for what other users post. Material you download or access through the Website is used at your own risk, except as otherwise stated in these Terms or as the law requires.

Pricing and Product Information Errors

We work to keep product information, prices, and availability accurate, but errors happen. If we discover an error, we may correct it and may cancel any order affected by it. If we cancel your order, we will refund everything you paid for it. We apologize for any inconvenience.

Third-Party Websites and Services

The Website may link to third-party websites and applications (“Third-Party Content”). We do not control Third-Party Content, and we may not warn you when you leave the Website. Third-Party Content has its own terms and privacy practices, and we are not responsible for it or for the accuracy, completeness, or reliability of the content, goods, or services of third parties we use or promote, even if they are affiliated with us. Please review their terms before you use them.

Your Responsibility for Claims by Others

If a third party brings a claim against Psycho Bunny because you broke these Terms, used the Website unlawfully, or infringed someone else’s rights through the Website, you agree to cover our reasonable losses from that claim, including reasonable attorneys’ fees, to the extent the law allows. This does not apply to claims that you bring against us, which are governed by the Arbitration Agreement if it applies to you.

Disclaimers

To the fullest extent the law allows, the Website and its content are provided “as is” and “as available.” We do not promise that the Website will be uninterrupted, secure, or error-free. Our products come with whatever warranties the law gives you. Nothing in these Terms removes those warranties or any other right you have under consumer protection law that cannot be waived.

Limits on Our Liability

To the fullest extent the law allows, Psycho Bunny is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits or revenues, that result from your use of or inability to use the Website. This does not limit our liability for our fraud, willful misconduct, or violation of law. It also does not limit any right or remedy you have under a consumer protection statute that cannot be waived, including statutory damages, restitution, injunctive relief, and attorneys’ fees and costs. Some places do not allow certain limits on liability, so some of this may not apply to you.

Technical Problems

The internet and electronic communications are not perfect. Except as stated in our Privacy Policy, in these Terms, or as the law requires, we are not responsible for delays, delivery problems, or technical failures that are outside our reasonable control. You are responsible for your own equipment and for any fees your internet or mobile provider charges.

Governing Law and Where Disputes Are Decided

If you live in the United States, the Federal Arbitration Act governs the Arbitration Agreement, and otherwise these Terms are governed by the laws of the state where you live, without regard to conflict of laws rules. If a dispute is not subject to arbitration, you and Psycho Bunny agree that it may be brought in the state or federal courts for the county where you live.

If you live outside the United States, these Terms are governed by the laws of Quebec and Canada to the extent they apply, without regard to conflict of laws rules, and the Arbitration Agreement does not apply to you. Any disputes that cannot be resolved informally may be brought in the courts of Montreal, Quebec, subject to any mandatory consumer protection rights you have under the law where you live.

Your use of the Website is also subject to all applicable international, federal, state, and local laws and regulations, including those of Canada and the United States.

General Terms

These Terms (including the Arbitration Agreement, if you have accepted it) and our Privacy Policy are the entire agreement between you and Psycho Bunny about the Website and, except as the Arbitration Agreement provides, replace all earlier versions of these Terms. You may also be subject to additional terms when you use third-party software to access the Website. If a court finds any part of these Terms invalid or unenforceable, that part will be read to reflect our intent as closely as the law allows, or removed if that is not possible, and the rest of these Terms will stay in effect. If we do not enforce a right under these Terms, we have not given it up. A waiver is valid only if it is in writing and signed by Psycho Bunny. Except as these Terms state, no third party has rights under them.
